This Privacy Policy describes how Foltrigg AI, LLC ("Foltrigg," "we," "us," or "our") collects, uses, shares, and protects information about visitors to our website at www.foltrigg.ai (opens in new window) and any other Foltrigg websites that link to this Policy (collectively, the "Site").

This Policy covers our Site only. It does not cover the Foltrigg software platform or any services we provide to Agency or enterprise customers under a separate written agreement, which are governed by the privacy terms of those agreements.

1. IMPORTANT NOTICE — CONSENT TO TRACKING AND RECORDING

Please read this section carefully before continuing to use the Site.

The Site uses cookies, pixels, software development kits, session replay technology, live chat technology, and other tracking and recording tools provided by third parties, including Google, Meta, and session replay and chat vendors (collectively, "Tracking Technologies"). These Tracking Technologies may:

  • record your interactions with the Site, including mouse movements, clicks, scrolls, keystrokes (other than within fields we configure to be masked, such as password fields), pages viewed, time spent on pages, and form interactions;
  • record the content of any chat conversation you initiate through the Site's chat widget;
  • collect device, browser, IP address, approximate location, and referral information;
  • share information with third parties for analytics, advertising, retargeting, and measurement purposes; and
  • create a recording or transcript that we and our service providers may review and store.

By accessing or continuing to use the Site, by interacting with any feature of the Site, or by initiating a chat conversation, you expressly consent to the collection, recording, use, sharing, and storage of your information as described in this Policy, including by the Tracking Technologies identified above and any successor or replacement technologies we adopt and disclose here. If you do not consent, you must exit the Site, decline non-essential cookies through our cookie preference tool, and refrain from initiating a chat conversation.

California residents: You are notified that your interactions with the Site, including chat conversations, may be recorded and reviewed by Foltrigg and its service providers. Your continued use of the Site, or your initiation of a chat conversation after viewing this notice, constitutes your consent to such recording under California Penal Code §§ 631, 632, and 632.7 and any successor or related provisions of the California Invasion of Privacy Act ("CIPA").

You may withdraw consent at any time by exiting the Site, adjusting your cookie preferences, declining to use the chat widget, or contacting us at privacy@foltrigg.ai (opens in new window). Withdrawal of consent does not affect the lawfulness of processing that occurred before withdrawal.

2. INFORMATION WE COLLECT

We collect information in three ways: information you provide to us, information collected automatically, and information from third parties.

Information you provide. When you fill out a form, request a demo, subscribe to communications, apply for a position, or contact us, we may collect your name, business email address, phone number, employer, job title, the agency or organization you represent, and the content of your message or inquiry.

Information collected automatically. When you visit the Site, we and our service providers automatically collect:

  • Technical and device information — IP address, browser type and version, operating system, device identifiers, screen resolution, language preference, and referring URL;
  • Usage information — pages visited, time and date of visits, time spent on pages, navigation paths, search terms entered, and links clicked;
  • Session replay information — recordings of your interactions with the Site, including mouse movements, clicks, scrolls, taps, keystrokes in non-masked fields, page transitions, and form field interactions (we configure these tools to mask sensitive form fields where reasonably practicable);
  • Chat information — the full content of any conversation conducted through the Site's chat widget, including any information you choose to share within that conversation; and
  • Approximate location — derived from IP address.

Information from third parties. We may receive information about you from analytics providers, advertising partners, enrichment vendors, lead-generation platforms, and public sources.

3. COOKIES AND TRACKING TECHNOLOGIES

We use the following categories of Tracking Technologies on the Site:

  • Strictly necessary — required to operate the Site, remember your cookie preferences, and maintain basic security.
  • Analytics — Google Analytics 4 and similar tools that measure traffic, engagement, and Site performance.
  • Advertising and retargeting — Meta (Facebook/Instagram) and Google advertising pixels and similar conversion and retargeting technologies.
  • Session replay — third-party session replay tools that record interactions as described in Section 2.
  • Chat — third-party chat or chatbot technology that records the contents of conversations conducted through the Site.

A cookie preference tool is, or will be, made available on the Site allowing you to accept, reject, or customize non-essential Tracking Technologies. You may also control cookies through your browser settings, opt out of Google Analytics via the Google Analytics Opt-Out Browser Add-on, opt out of personalized Meta advertising through your Meta account settings, and opt out of Google advertising personalization at adssettings.google.com (opens in new window). Disabling certain Tracking Technologies may degrade Site functionality.

We do not currently respond to browser "Do Not Track" signals, but we do honor recognized opt-out preference signals (including the Global Privacy Control) for California and other applicable residents as required by law.

4. HOW WE USE INFORMATION

We use information collected through the Site to:

operate, maintain, secure, and improve the Site; respond to inquiries, demo requests, and chat messages; send marketing and informational communications you have requested or for which we have a lawful basis; measure and analyze Site traffic, performance, and user experience, including through session replay; serve, measure, and improve advertising and retargeting; detect, investigate, and prevent fraud, abuse, security incidents, and violations of our terms; comply with legal obligations, respond to lawful requests, and enforce our agreements; and conduct ordinary business operations including recordkeeping, audits, and analytics.

We do not use Site-collected information to train, fine-tune, or improve any shared or general artificial intelligence model.

5. HOW WE SHARE INFORMATION

We share information collected through the Site with the following categories of recipients:

  • Service providers and processors acting on our behalf, including hosting, analytics, advertising, session replay, chat, email, CRM, and security vendors, who are contractually required to use the information only for the services they provide to us;
  • Advertising partners for measurement, retargeting, and audience-building purposes, which may constitute "sharing" or "sale" of personal information under California and certain other state privacy laws as described in Section 7;
  • Affiliates within the Foltrigg corporate family;
  • Successors in connection with a merger, acquisition, reorganization, financing, or sale of all or substantially all of our assets;
  • Legal recipients when we believe in good faith that disclosure is required by applicable law, subpoena, court order, warrant, or other lawful process, or is necessary to protect the rights, property, or safety of Foltrigg, our users, or others; and
  • With your consent for any other purpose disclosed to you at the time of collection.

We do not knowingly sell personal information for monetary consideration. Some of our advertising and analytics arrangements may, however, qualify as a "sale" or "sharing" of personal information under California and other state privacy laws. See Section 7 for opt-out instructions.

6. SECURITY AND RETENTION

We use reasonable administrative, technical, and physical safeguards designed to protect information collected through the Site from unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

We retain information collected through the Site only as long as reasonably necessary for the purposes described in this Policy, to comply with our legal, accounting, audit, insurance, and regulatory obligations, to resolve disputes, and to enforce our agreements. Session replay recordings and chat transcripts are retained per our vendor configurations and may be deleted on a rolling basis.

7. CALIFORNIA PRIVACY RIGHTS (CCPA / CPRA AND CIPA)

This Section supplements the rest of this Policy for California residents.

Categories collected in the last 12 months. We have collected the following categories of personal information under the CCPA/CPRA: identifiers (name, email, IP address, online identifiers); commercial information (services requested, inquiry history); internet or other electronic network activity information (browsing history, search history, interactions with the Site, session replay recordings); geolocation data (approximate location from IP); professional or employment-related information (employer, title, agency); and inferences drawn from the foregoing.

Sources, purposes, and disclosures are as described in Sections 2, 4, and 5. We do not knowingly collect sensitive personal information through the Site beyond what visitors voluntarily provide in forms or chat. We do not knowingly collect personal information from children.

Your California rights. Subject to verification and applicable exceptions, you have the right to:

  • Know what personal information we have collected about you, the sources, the purposes, and the categories of third parties with whom we have shared it;
  • Access a copy of your personal information in a portable format;
  • Correct inaccurate personal information;
  • Delete personal information we have collected from you;
  • Opt out of "sale" or "sharing" of personal information for cross-context behavioral advertising;
  • Limit the use of sensitive personal information to specified purposes; and
  • Not be subject to retaliation or discrimination for exercising these rights.

To exercise your rights, email privacy@foltrigg.ai (opens in new window) or use the request mechanism available on the Site. We will verify your identity before responding. You may designate an authorized agent to act on your behalf, subject to verification.

Do Not Sell or Share My Personal Information. To opt out of "sale" or "sharing" for cross-context behavioral advertising, use the "Do Not Sell or Share My Personal Information" link on the Site, enable the Global Privacy Control in your browser, or email privacy@foltrigg.ai (opens in new window).

CIPA notice. As described in Section 1, the Site uses session replay and chat technologies that record your interactions. By continuing to use the Site or by initiating a chat conversation after viewing this Policy, you consent to such recording under California Penal Code §§ 631, 632, and 632.7. If you do not consent, you must exit the Site and refrain from initiating a chat conversation.

8. OTHER STATE PRIVACY RIGHTS

Residents of states with comprehensive consumer privacy laws — including, where applicable, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Delaware, Tennessee, Indiana, New Jersey, Minnesota, Maryland, Nebraska, New Hampshire, Kentucky, Rhode Island, and others — may have rights similar to those described in Section 7, including the rights to access, correct, delete, port, and opt out of targeted advertising, the "sale" of personal data, and certain types of profiling.

To exercise these rights, email privacy@foltrigg.ai (opens in new window). We will respond within the time periods required by applicable law. If we deny your request, you may have the right to appeal by replying to our response with the word "Appeal" in the subject line and explaining the basis for your appeal.

We honor the Global Privacy Control as a valid opt-out preference signal where required by applicable law.

9. THIRD-PARTY LINKS AND SERVICES

The Site may contain links to third-party websites, plug-ins, or services that we do not operate. This Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of every third-party site you visit.

10. CHILDREN

The Site is intended for business and professional users and is not directed to children under 16. We do not knowingly collect personal information from children under 16 through the Site. If you believe a child has provided personal information to us, please contact privacy@foltrigg.ai (opens in new window) and we will take steps to delete it.

11. CHANGES TO THIS POLICY

We may update this Policy from time to time. When we do, we will revise the "Last Updated" date above and, if changes are material, provide additional notice (for example, by posting a banner on the Site or by email if we have your address). Your continued use of the Site after the effective date of the revised Policy constitutes your acceptance of the changes.
